These Terms are written to be launch-ready but are general information, not legal advice for your specific situation.

1. Who we are

Throat Theory ("Throat Theory," "we," "us," "our") operates the website and application at throattheory.com (together, the "Service"), an 18+ social and dating platform for adult gay and bisexual men. 2. You must be 18 or older

The Service is strictly for adults. By using it, you represent and warrant that you are at least 18 years old (or the age of majority where you live, if that is higher) and that you will complete any age or identity verification we require. We use one or more independent third-party verification providers to confirm you are an adult. We do not store copies of your government ID; our provider confirms your age and returns only a pass/fail result to us. We may refuse, suspend, or terminate access if we cannot confirm you are an adult. Permitting anyone under 18 to access the Service through your account is strictly prohibited.

3. Acceptance of these Terms

By creating an account or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines, each of which is incorporated here by reference. If you do not agree, do not use the Service.

4. Your account

You are responsible for your account and for keeping your login credentials secure. You agree to provide accurate information and to keep it current. One account per person. You may not share, sell, or transfer your account. We may suspend or remove accounts that violate these Terms or that we reasonably believe are fraudulent, automated, or created to impersonate another person.

5. Verification and the verification fee

A core promise of the Service is that every profile belongs to a verified real human. To join, you complete a one-time identity/age verification, for which we charge a one-time fee (currently US$4.99). This fee exists to make mass fake-account creation uneconomical; it is not a subscription and does not, by itself, grant any paid membership tier. Verification is performed by our third-party provider(s), and completing it does not guarantee continued access if you later violate these Terms.

6. Content and conduct

You are solely responsible for the content you create, upload, or share. You must own or have all necessary rights to everything you post. Every identifiable person depicted in any sexually explicit content must be an adult who has consented, and records must be maintained consistent with our 18 U.S.C. §2257 notice. The following are strictly prohibited and will result in immediate removal, account termination, and, where the law requires, reporting to authorities:

7. Safety, moderation, scanning and reporting

We operate reporting and review systems, and we scan uploaded media for known illegal material and policy violations. We cooperate with the National Center for Missing & Exploited Children (NCMEC), the Canadian Centre for Child Protection (Cybertip.ca), and law enforcement as required by law. We may remove content, restrict features, and report activity without prior notice where we believe the law requires it or where there is a risk to safety. Safety tools we provide (such as scam warnings or meeting check-ins) are aids, not guarantees; you remain responsible for your own safety when meeting anyone in person.

8. License to your content

You keep ownership of the content you post. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit that content solely to operate, provide, and improve the Service. This license ends when you delete the content or your account, except for (a) copies we are legally required to retain, and (b) content already shared with others before deletion.

9. Payments, renewals and refunds

Paid features (including the verification fee and any future memberships) are billed through our third-party payment processor. Prices and any billing cycles are shown at the point of purchase. Because verification and digital access are delivered immediately, all fees are non-refundable except where a refund is required by applicable law. Where you have statutory refund or cancellation rights (for example, certain consumer-protection rights in your country or region), those rights are not affected by this section. Chargebacks made in bad faith may result in account termination.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that verification will detect every bad actor. We are not responsible for the conduct of any user, online or offline.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US$100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

13. Termination

You may stop using the Service and delete your account at any time from your settings. Sections that by their nature should survive termination (including content license limits, disclaimers, limitation of liability, indemnity, and governing law) will survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "last updated" date and, where appropriate, notice in the app. Continued use after changes take effect means you accept the updated Terms.

15. Governing law & disputes

These Terms are governed by the laws of the State of [STATE] and the applicable federal laws of the United States, without regard to conflict-of-laws rules. You agree that the state and federal courts located in [STATE] will have jurisdiction over any dispute not subject to other agreed dispute-resolution processes, subject to any mandatory consumer-protection rights you have where you live.
